SMSFs, property, LRBA, international issues, and more: The road ahead

One year on from the
introduction of the most significant superannuation reforms in over a decade,
practitioners working at the coalface are experiencing a diverse range of
compliance and planning issues which, only now are coming to light.
In his workshop SMSFs, property & LRBA’,  at the upcoming at the  WA Superannuation Intensive, Phil Broderick, CTA (Sladen Legal)
will cover the ins and outs of property in SMSFs.
Looking at everything involved in getting property
into an SMSF, issues with holding a property once it is an SMSF, and finally how to take a property
out of the SMSF, Phil explains ‘Of course, I’ll be examining all of the tax
issues that come up along the way - both Federal and State. Delegates should leave with a good
knowledge of the issues relating to SMSFs and property investments; which will
leave them in good stead for investing in, or dealing with, property in an

Phil is a principal at Sladen Legal in
Melbourne and is heavily involved in various superannuation industry
consultation forums with Treasury and the ATO, including the Superannuation
Industry Relationship Network (SIRN) and the Superannuation Industry
Stewardship Group (SISG).

Phil, who keeps busy outside of work with
his three children and likes to escape the world of Superannuation by taking
his family camping, will be presenting at both the WA Superannuation
and the Victoria
Superannuation Day
as part of the 2019
National Superannuation Series
in March.

When asked which session he is most looking
forward to at the WA Intensive, Phil said he was particularly interested in Naree Brook’s
presentation on international issues.

Naree Brooks, CTA (PwC), alongside fellow
Melbournian Phil, will be making the trip over to Perth to present at the WA Superannuation
on 21-22 March.

Naree’s session, ‘International issues with SMSFs’, will provide delegates with a
comparison on the Australian tax consequences when looking to access funds from
overseas pension accounts versus rolling the benefits to an Australian
superannuation fund.

Furthermore, Naree will discuss some of the
high-level tax issues to consider in the foreign jurisdiction and a summary of
all the issues a member of an SMSF must deal with when taking an extended
period of time overseas. Naree will also touch on some of the issues to
consider as SMSFs start investing globally.

When asked what delegates would take away
from her session, Naree explained, ‘this session will enable advisers to have a
good understanding of how the legislation works in relation to the repatriation
of overseas funds to an SMSF from foreign jurisdictions, reviewing the various
options available and the pitfalls that can occur. Delegates will walk away
with practical solutions for SMSF members that work overseas for extended
periods of time.’
